FIRST SECTION
DECISION
Application no 41255/09 Vincenzo MINELLI against Italy and 6 other applications (see list appended)
The European Court of Human Rights (First Section), sitting on 17 November 2016 as a committee composed of:
Robert Spano, President, Pauliine Koskelo, Tim Eicke, judges, and Hasan Bakırcı , Deputy Section Registrar ,
Having regard to the above applications lodged on the dates indicated in the appended table,
Having deliberated, decides as follows:
THE FACTS
A list of the applicants is set out in the appendix.
The applicants ’ complaints under Article 6 § 1 of the Convention concerning the excessive length of civil proceedings were communicated to the Italian Government (“the Government”) , who submitted observations on the admissibility and merits. The observations were forwarded to the applicants, who were invited to submit their own observations.
Between 23 and 26 May 2016 the Registry sent a letter to the applicants inviting them to submit any comments which they may wish to make in reply.
Between 13 August and 28 September 2016 the Registry received these letters back with an annotation by the Italian Post Office that the respective addressees were “unknown”. No change of address has been communicated to the Court.
THE LAW
Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision.
In the light of the foregoing, t he Court concludes that the applicants may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the applications.
Accordingly, the cases should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to join the applications;
Decides to strike the applications out of its list of cases.
Done in English and notified in writing on 8 December 2016 .
