THIRD SECTION
DECISION
Application no . 51133/08 Yelena Lvovna YEREMINA against Russia
The European Court of Human Rights (Third Section), sitting on 17 November 2016 as a Committee composed of:
Helena Jäderblom, President, Dmitry Dedov, Branko Lubarda, judges,
and Hasan Bakırcı, Deputy Section Registrar,
Having regard to the above application lodged on 13 August 2008 ,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Ms Yelena Lvovna Yeremina, was born in 1978.
The applicant ’ s complaints under Article 6 § 1 of the Convention concerning the excessive length of criminal proceedings were communicated to the Russian Government (“the Government”) , who submitted observations on the admissibility and merits. .
By letter dated 3 February 2016, sent by registered post, the applicant was notified that the period allowed for submission of her observations had expired on 11 December 2015 and that no extension of time had been requested. On 21 March 2016 the postal service sent the letter back to the Court, because the delivery of the letter was impossible since the applicant moved without leaving any contact details.
The Court reiterates that under Rule 47 § 7 of the Rules of Court applicants shall keep the Court informed of any change of address and of all circumstances relevant to the application. The Court considers that the applicant ’ s failure to inform the Registry about the developments in her case, the change of her address, and the absence of any correspondence from her for nearly three years, indicate that she has lost interest in the complaint.
THE LAW
In the light of the foregoing, t he Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
Done in English and notified in writing on 8 December 2016 .
