FOURTH SECTION
DECISION
Application no . 58729/11 Tamás BODOKY against Hungary
The European Court of Human Rights (Fourth Section), sitting on 4 April 2017 as a Committee composed of:
Vincent A. De Gaetano, President, Egidijus Kūris , Gabriele Kucsko-Stadlmayer , judges,
and Andrea Tamietti , Deputy Section Registrar ,
Having regard to the above application lodged on 13 September 2011,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
1. The applicant, Mr Tamás Bodoky , is a Hungarian national, who was born in 1971 and lives in Budapest. He was represented before the Court by Mr L. Baltay , a lawyer practising in Gyál .
2. The Hungarian Government (“the Government”) were represented by Mr Z. Tallódi , Agent at the Ministry of Justice.
3. The applicant complained that the withholding of the information sought, under the pretext of bank secrecy, infringed his rights under Article 10 of the Convention, in that he could not exercise his role as an investigative journalist to inform the public of a matter of general interest.
4. On 27 January 2017 the applicant informed the Court that he wanted to withdraw the application as the matter has been resolved, without giving further details.
THE LAW
5. In the light of the above, the Court considers that the matter has been resolved within the meaning of Article 37 § 1 (b) of the Convention and that respect for human rights as defined in the Convention and its Protocols does not require it to continue the examination of the application under Article 37 § 1 in fine .
6. Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
Done in English and notified in writing on 4 May 2017 .
