Having regard to the above application lodged on 27 March 2013 ,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The applicant, Mr Tibor Spitzer, was born in 1963.
The applicant ’ s complaint under Article 6 § 1 of the Convention concerning the excessive length of civil proceedings was communicated to the Government on 5 July 2016. The Government, by letter of 14 October 2016, informed the Court that they were ready to accept the friendly settlement proposal. T he applicant was informed thereof by a letter dated 13 January 2017. The applicant has not responded to the letter. By a letter dated 22 February 2017, sent by registered post, the applicant was requested to reply within one month. The letter was returned to the Court by the Hungarian Post as undeliverable on 13 March 2017.
In brief, all the correspondence on the Registry ’ s side has remained unanswered. The applicant has failed to inform the Registry about any change of address and has not, to date, resumed correspondence with the Court. In fact, n o communication from the applicant ’ s side has reached the Court since 27 March 2013.
THE LAW
In the light of the foregoing, t he Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
