Application no . 62416/15 Konstantin Rudolfovich FILIMONOV and Others against Russia

The European Court of Human Rights (Third Section), sitting on 5 September 2017 as a Committee composed of:

Luis López Guerra, President, Dmitry Dedov, Jolien Schukking, judges,

and Fatoş Aracı, Deputy S ection Registrar ,

Having regard to the above application lodged on 18 December 2015,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

A list of the applicants is set out in the appendix. The applicants were represented before the Court by Ms Anna Maralyan, a lawyer practising in Strasbourg.

The Russian Government (“the Government”) were represented initially by Mr G. Matyushkin, the Representative of the Russian Federation to the European Court of Human Rights, and then by his successor in that office, Mr M. Galperin.

The applicants complained under Article 8 and Article 1 of Protocol No. 1 to the Convention about deprivation of property and eviction.

On 17 November 2016 the Court decided to give notice to the Government of the applicants ’ complaints detailed above.

On 15 March 2017 the Government submitted to the Registry their observations on the admissibility and merits of the application. These were forwarded on 20 March 2017 to the applicants, who were invited to submit observations in reply by 22 May 2017.

On 10 April 2017 the applicants ’ representative informed the Court that the applicants wanted to withdraw the application as they had received redress at the national level.

THE LAW

In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention or its Protocols, the Court, in accordance with Article 37 § 1 (a) of the Convention, considers that it is no longer justified to continue the examination of the application.

In view of the above, it is appropriate to strike the case out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
