DECISION

Application no . 58440/10 Suzan ZENGİN against Turkey

The European Court of Human Rights (Second Section), sitting on 21 september 2017 as a Committee composed of:

Nebojša Vučinić, President, Valeriu Griţco, Jon Fridrik Kjølbro, judges,

and Liv Tigerstedt, Acting Deputy Section Registrar,

Having regard to the above application lodged on 8 September 2010 ,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Ms Suzan Zengin, was born in 1959.

She was represented before the Court by Mr H. KarakuÅŸ, a lawyer practising in Istanbul.

The applicant ’ s complaints concerning the excessive length of her pre-trial detention and the lack of compensation were communicated to the Turkish Government (“the Government”) under Article 5 §§ 3 and 5 of the Convention .

On 30 August 2016 the Government informed the Registry that the applicant had died. By a letter dated 23 May 2017, sent by registered post, the applicant ’ s representative was asked to indicate whether the applicant ’ s heirs wished to continue the application and submit relevant documents regarding the intestate succession. This letter was returned to the Court as the representative had moved from the address of which he had notified the Court, without informing the Court of the change of address.

THE LAW

In the light of the foregoing, and in the absence of any special circumstances regarding respect for the rights guaranteed by the Convention or its Protocols, the Court considers that it is no longer justified to continue the examination of the application within the meaning of Article 37 § 1 (a) of the Convention .

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
