FOURTH SECTION
DECISION
Application no . 48790/15 Vesna ŠINKO and Slavka MILAKOVIĆ against Slovenia
The European Court of Human Righ ts (Fourth Section), sitting on 10 October 2017 as a Committee composed of:
Vincent A. De Gaetano, President, Georges Ravarani , Marko Bošnjak , judges, and Andrea Tamietti, Deputy Section Registrar ,
Having regard to the above application lodged on 30 September 2015,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
1. The applicants, Ms Vesna Šinko and Ms Slavka Milaković , are Slovenian nationals, who were born in 1961 and 1937 respectively and live in Zgornja Besnica and Kranj . They were represented before the Court by Mr M. Savnik , a lawyer practising in Kranj .
2. The applicants ’ complaints concerning the procedural obligation under Article 2 of the Convention were communicated to the Slovenian Government (“the Government”), who were represented by their Agent, Mrs T. Mihelič Žitko , State Attorney.
3. The applicants failed to respond to the last Registry ’ s letter of 13 March 2017 (received by their representative on 20 March 2017), reminding them that the period allowed for submission of their observations on the admissibility and merits of the application in one of the Court ’ s official languages had expired on 1 March 2017 and that no extension of time had been requested. Their attention was drawn to Article 37 § 1 (a) of the Convention.
THE LAW
4. The Court considers that, in these circumstances, the applicants may be regarded as no longer wishing to pursue their application, within the meaning of Article 37 § 1 (a) of the Convention. Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and its Protocols which require the continued examination of the case.
In view of the above, it is appropriate to strike the case out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
Done in English and notified in writing on 2 November 2017 .
