DECISION

Application no . 8754/10 Maciej ZIEMBIŃSKI against Poland

The European Court of Human Rights (First Section), sitting on 17 October 2017 as a Committee composed of:

Aleš Pejchal , President, Krzysztof Wojtyczek, Jovan Ilievski, judges, and Renata Degener, Deputy Section Registrar ,

Having regard to the above application lodged on 19 July 2007,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

1. The applicant, Mr Maciej Ziembiński , a Polish national, was born in 1944 and lived in Kłomnice . He was represented before the Court by Ms K. Zakrzewska , a lawyer practising in Radomsko .

2. The Polish Government (“the Government”) were represented by their Agent, Mr J. Wołąsiewicz , succeeded by Ms J. Chrzanowska , of the Ministry of Foreign Affairs.

3. The applicant complained under Article 10 of the Convention that his conviction for insult had amounted to a violation of his right to freedom of expression.

4. On 6 September 2010 the Court decided to give notice to the Government of the applicant ’ s complaint detailed above.

5. The Government and the applicant submitted to the Registry their observations on the admissibility and merits of the application.

6. By a letter dated 7 August 2017 the applicant ’ s lawyer informed the Registry that the applicant had died on 15 May 2014. No heirs presented themselves to pursue the application.

THE LAW

7. In the light of the foregoing, the Court considers that it is no longer justified to continue the examination of the application within the meaning of Article 37 § 1 (c) of the Convention.

In view of the above, it is appropriate to strike the case out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
