DECISION

Application no . 57437/12 Rusudan JAVAKHISHVILI and others against Georgia

The European Court of Human Rights (Fifth Section), sitting on 7 November 2017 as a Committee composed of:

Síofra O ’ Leary, President, Nona Tsotsoria, Lәtif Hüseynov, judges,

and Anne-Marie Dougin, Acting Deputy Section Registrar ,

Having regard to the above application lodged on 27 August 2012,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

1. A list of the applicants is set out in the appendix.

2. The applicants ’ complaints under Article 1 of Protocol no. 1 were communicated to the Georgian Government (“the Government”), who were represented by their Agent, Mr B. Dzamashvili, of the Ministry of Justice.

3. The applicants failed to respond to the last Registry ’ s letter of 25 August 2017 with its enclosure (sent by registered mail and received by the first applicant (see the appendix) on 5 September 2017), reminding them that the period allowed for submission of their observations in reply had expired on 8 June 2017 and that no extension of time had been requested. Their attention was drawn to Article 37 § 1 (a) of the Convention.

THE LAW

4. The Court considers that, in these circumstances, the applicants may be regarded as no longer wishing to pursue their application, within the meaning of Article 37 § 1 (a) of the Convention. Furtherm ore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and its Protocols which require the continued examination of the case.

In view of the above, it is appropriate to strike the case out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
