FIFTH SECTION

DECISION

Application no. 71082/12 Galyna Sydorivna SVINTSITSKA against Ukraine and 2 other applications (see list appended)

The European Court of Human Rights (Fifth Section), sitting on 9 January 2018 as a Committee composed of:

Erik Møse, President, Síofra O ’ Leary, Lәtif Hüseynov, judges,

and Anne-Marie Dougin, Acting Deputy Section Registrar ,

Having regard to the above applications lodged on the various dates indicated in the appended table ,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

1. A list of the applicants is set out in the appendix.

2. The applicants ’ complaints under Article 1 of Protocol No. 1 were communicated to the Ukrainian Government (“the Government”), who were represented by their Agent, Mr I. Lishchyna.

3. On 30 March 2017 a letter was sent by registered mail to the applicants by the Registry, reminding them that the period allowed for submission of their observations in reply had expired on 16 December 2016 and that no extension of time had been requested. Their attention was drawn to Article 37 § 1 (a) of the Convention.

4. The letters sent to the first and third applicants were returned to the Registry with the postmark “non réclamé ” . According to a postal receipt, the second applicant received the letter on 3 May 2017. However, she failed to respond.

THE LAW

5. Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision.

6. The Court attempted to contact the applicants at the addresses indicated by them, but to no avail. The first and third applicants did not inform the Court of any change of address. The second applicant, despite having received the Court ’ s correspondence, failed to respond.

7. The Court considers that, in these circumstances, the applicants may be regarded as no longer wishing to pursue their applications, within the meaning of Article 37 § 1 (a) of the Convention. Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and its Protocols which require the continued examination of the cases.

8. In view of the above, it is appropriate to strike the case s out of the list.

For these reasons, the Court, unanimously,

Decides to join the applications;

Decides to strike the applications out of its list of cases.
