Application no. 44103/16 Liviu BERIS and Association of the Romanian Jews Victims of the Holocaust ( AERVH) against Romania
The European Court of Human Rights (Fourth Section), sitting on 29 August 2019 as a Committee composed of:
Stéphanie Mourou-Vikström, President, Georges Ravarani, Jolien Schukking, judges,
and Liv Tigerstedt, Acting Deputy Section Registrar,
Having regard to the above application lodged on 15 July 2016 ,
Having deliberated, decides as follows:
FACTS AND PROCEDURE
The list of the applicants is set out in the appendix.
The applicants were represented by Ms G. Iorgulescu, of the Centre for Legal Resources.
The applicants ’ complaints under Articles 3, 6 § 1, 8, 14 and Article 1 of Protocol No. 12 to the Convention concerning the authorities ’ alleged refusal to grant them access to criminal files classified as secret were communicated to the Romanian Government (“the Government”).
On 8 April 2019 the applicants informed the Registry that they wanted to withdraw the application to the Court.
THE LAW
In the light of the foregoing, t he Court concludes that the applicants may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the C ourt finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.
Accordingly, the case should be struck out of the list.
For these reasons, the Court, unanimously,
Decides to strike the application out of its list of cases.
