DECISION

Application no. 68849/14 Kateryna Oleksandrivna ADAMETS against Ukraine and Russia

The European Court of Human Rights (First Section), sitting on 29 August 2019 as a Committee composed of:

Aleš Pejchal, President, Jovan Ilievski, Raffaele Sabato, judges,

and Liv Tigerstedt, Acting Deputy Section Registrar,

Having regard to the above application lodged on 22 October 2014 ,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Ms Kateryna Oleksandrivna Adamets, was born in 1995.

The applicant was represented by Ms V.P. Lebid, a lawyer practising in Kyiv.

The applicant ’ s complaints under Articles 3, 5 and 13 of the Convention, concerning her relative ’ s alleged ill-treatment in captivity and the long-lasting uncertainty about his fate which caused her serious mental sufferings, as well as her relative ’ s allegedly unlawful deprivation of liberty and the respondent Governments ’ alleged failure to take the necessary measures to secure her Convention rights, were communicated to the respondent Governments on 15 January 2019.

On 16 May 2019 the applicant informed the Registry that she wanted to withdraw the application to the Court.

THE LAW

In the light of the foregoing, t he Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
