DECISION

Application no. 80450/13 Mona AHMED SHEEKH and others against the Netherlands

The European Court of Human Rights (Fourth Section), sitting on 12 September 2019 as a Committee composed of:

Stéphanie Mourou-Vikström, President, Georges Ravarani, Jolien Schukking, judges, and Liv Tigerstedt, Acting Deputy Section Registrar,

Having regard to the above application lodged on 17 December 2013 ,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The list of the applicants is set out in the appendix.

The applicants were represented by Ms A. Kessels, a lawyer practising in Amsterdam.

The applicants complained under Article 8 of the Convention of the refusal to grant the first two applicants admission to the Netherlands for the purpose of family reunification with the third applicant.

On 3 June 2019 the Registry sent a letter to the applicants ’ representative requesting information concerning, inter alia , their current circumstances. No reply was received to this letter.

By letter dated 9 July 2019, sent by registered post, the applicants ’ representative was reminded of the outstanding request for information. The representative ’ s attention was drawn to the possibility that the Court may strike an application out of its list of cases where the circumstances lead to the conclusion that the applicant does not intend to pursue the application. This letter was received at the address of the representative ’ s law firm on 15 July 2019. However, no response has been received.

THE LAW

In the light of the foregoing, the Court concludes that the applicants may be regarded as no longer wishing to pursue the application within the meaning of Article 37 § 1 (a) of the Convention. Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application. Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
