Application s no s . 64761/13 and 43455/17 Vitaliy Viktorovich STARIKOV against Russia

The European Court of Human Rights ( Third Section ), sitting on 5 March 2020 as a Committee composed of:

Alena Poláčková , President, Dmitry Dedov , Gilberto Felici , judges, and Liv Tigerstedt , Acting Deputy Section Registrar,

Having regard to the above application s lodged respectively on 18 September 2013 and 19 April 2017 ,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant was born in 1980 and lived in Krasnoyarsk.

The applicant ’ s complaints under Articles 3, 8, 13 and 34 of the Convention concerning the various difficulties affecting his detention in remand prison were communicated to the Russian Government (“the Government”) .

On 14 May 20 19 the G overnment informed the Court about the applicant ’ s death. On 23 May 20 19 letters were sent by registered mail to the applicant ’ s addresses to find out if there was anyone wishing to pursue the case. No reply has been received .

THE LAW

Having regard to the similar subject matter of the applications, the Court finds it appropriate to examine them jointly in a single decision.

In the light of the foregoing, the Court concludes that the applicant ’ s heirs do not wish to pursue the application s within the meaning of Article 37 § 1 (a) of the Convention. Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application s .

Accordingly, the case s should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to join the applications ;

Decides to strike the application s out of its list of cases.
