DECISION

Application no. 39513/20 Namahoro Francine KAMALIZA against the Netherlands

The European Court of Human Rights (Fourth Section), sitting on 8 April 2021 as a Committee composed of:

Armen Harutyunyan, President, Jolien Schukking, Ana Maria Guerra Martins, judges, and Viktoriya Maradudina, Acting Deputy Section Registrar,

Having regard to the above application lodged on 28 August 2020,

Having deliberated, decides as follows:

FACTS AND PROCEDURE

The applicant, Ms Namahoro Francine Kamaliza, was born in 1995.

The applicant was represented by Ms P. Kramer-Ograjensek, a lawyer practising in Sittard.

The applicant’s complaints under Article 8 of the Convention concerning the rejection of her application for family reunion with her siblings were communicated to the Dutch Government (“the Government”).

On 8 March 2021 the Government informed the Court that it had been decided to grant a provisional residence visa ( machtiging tot voorlopig verblijf ), as well as a residence permit valid for five years to the applicant’s siblings.

In a letter of 15 March 2021, the applicant’s representative stated that in view of this development the applicant wanted to withdraw her application.

THE LAW

In the light of the foregoing, the Court concludes that the applicant may be regarded as no longer wishing to pursue the application (Article 37 § 1 (a) of the Convention). Furthermore, in accordance with Article 37 § 1 in fine , the Court finds no special circumstances regarding respect for human rights as defined in the Convention and the Protocols thereto which require the continued examination of the application.

Accordingly, the case should be struck out of the list.

For these reasons, the Court, unanimously,

Decides to strike the application out of its list of cases.
