COMMISSION REGULATION (EC) No 1490/97 of 29 July 1997 amending Regulation (EEC) No 3846/87 establishing an agricultural product nomenclature for export refunds THE COMMISSION OF THE EUROPEAN COMMUNITIES, Having regard to the Treaty establishing the European Community, Having regard to Council Regulation (EEC) No 804/68 of 27 June 1968 on the common organization of the market in milk and milk products (1), as last amended by Regulation (EC) No 1587/96 (2), and in particular Article 17 (14) thereof, Whereas Commission Regulation (EEC) No 3846/87 (3), as last amended by Regulation (EC) No 1297/97 (4), establishes on the basis of the combined nomenclature an agricultural product nomenclature for export refunds; whereas the nomenclature lays down the requirements relating to the product codes for cheeses for which a refund is granted, in particular as regards the maximum water content and minimum fat content; whereas the requirements for certain cheeses have to be adjusted so that they reflect better the cheeses actually exported; Whereas, in the case of whey cheeses falling within CN codes 0406 10 20 and 0406 90 87, it should be specified that salted Ricotta and Manouri, while manufactured from whey, are classified separately in the nomenclature for export refunds; Whereas the measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Milk and Milk Products, HAS ADOPTED THIS REGULATION: Article 1 In Sector 9 of the Annex to Regulation (EEC) No 3846/87, the information on CN codes ex 0406 10 20, ex 0406 90 31, ex 0406 90 33, ex 0406 90 73, ex 0406 90 76, ex 0406 90 81 and ex 0406 90 87 is replaced by the information in the Annex hereto. Article 2 This Regulation shall enter into force on the seventh day following its publication in the Official Journal of the European Communities. This Regulation shall be binding in its entirety and directly applicable in all Member States. Done at Brussels, 29 July 1997. THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Council Regulation (EEC) No 804/68 of 27 June 1968 on the common organization of the market in milk and milk products (1), as last amended by Regulation (EC) No 1587/96 (2), and in particular Article 17 (14) thereof,
